الملخـص:
إشكالية الحاكمية بين النص الإسلامي والتطاول الحداثي تتمثل في التوتر بين المفهوم الإسلامي التقليدي للحاكمية كسلطة لله وحده في التشريع، ومحاولات الحداثيين تأويل النصوص بما يخدم رؤى معاصرة قد تتجاوز المرجعية الدينية. يُستخدم مصطلح "الحاكم" في أصول الفقه منذ قرون للدلالة على الله كمصدر للتشريع، ما ينفي حداثة المفهوم. الحداثيون كثيرًا ما يتجاهلون هذا الجذر الأصيل ويُسقِطون مفاهيم غربية على بنية النص. من هنا تبرز الإشكالية في تسييس وتأويل المصطلح خارج سياقه الشرعي.
الأهداف مع منهج إنجاز البحث: اعتمادنا المنهج المقارن مع التحليلي في دراسة إشكالية الحاكمية، حيث يقوم المنهج التحليلي بتفكيك المفاهيم المرتبطة بالحاكمية في النصوص القرآنية وأصول الفقه، بينما يتيح المنهج المقارن مواجهة هذه المفاهيم مع الطروحات الحداثية التي أعادت تأويل المصطلح وفق خلفيات فكرية معاصرة.
ويهدف البحث إلى: توضيح المعنى الأصلي للحاكمية في السياق الإسلامي، وكشف الانحرافات التأويلية في الخطاب الحداثي، الدفاع عن المرجعية الإسلامية، وبيان أصالة المصطلح في التراث الفقهي الإسلامي.
 
Abstract:
The issue of sovereignty between Islamic texts and modernist overreach lies in the tension between the traditional Islamic concept of sovereignty as the sole authority of God in legislation and the attempts of modernists to reinterpret texts to serve contemporary views that may transcend religious references. The term "sovereignty" (al-Hākim) has been used in Islamic jurisprudence for centuries to denote Allah as the sole source of legislation، thus negating the modernity of the concept. Modernists often overlook this original root and impose Western concepts onto the structure of the text. This creates an issue in the politicization and misinterpretation of the term outside its legitimate Shari'ah context.
Research Goals and Methodology:
This study adopts a comparative and analytical methodology to address the issue of sovereignty. The analytical method is employed to deconstruct the concepts associated with sovereignty in the Qur'anic texts and Islamic jurisprudence، while the comparative method allows for a confrontation of these concepts with the modernist reinterpretations that have redefined the term according to contemporary intellectual backgrounds.
The research aims to:

Clarify the original meaning of sovereignty within the Islamic context.
Uncover the interpretative deviations in modernist discourse.
Defend the Islamic reference point and demonstrate the originality of the term in the Islamic jurisprudential heritage.
