تعــديل العوامــل الوراثيـة دراسـة فقهيـة

ملخص البحث
يُعد العلاج من الأمور المشروعة، لکونه يحقق مقصداً من مقاصد الشريعة الإسلامية وهو حفظ النفس، ولکن لما تطورت طرق الطب بما فتح باباً لممارسة العديد من الوسائل العلاجية والتي لا تقتصر على التخلص من الأمراض، إنما تعدى ذلک إلى التدخل في تغيير الهيئة الأصلية للکائن الحي ثار الخلاف في حکم هذا التعديل. ويتناول البحث بيان مدى أهمية تعديل العوامل الوراثية بالعلاج الجيني للکائن الحي، والذي يُعد من ثمار الثورة العلمية والتطور التکنولوجي السريع والمتلاحق، ومن ثم معرفة حکمه حيث قد تطورت وسائل الطب وأهدافه بحيث لم تقتصر على التخلص من الأمراض، إنما تدخلت في الکائنات الحية بتغييرها عن هيئتها الأصلية بإدخال جين أو استبداله أو استئصاله.کما يستهدف وضع الضوابط الشرعية والطبية لتعديل العوامل الوراثية بما يضمن الاستفادة بإيجابياته وتجنب سلبيات استخدامه، ومن ثم اشتمل البحث على فصلين وخاتمة، وبينت في الفصل الأول المقصود بتعديل العوامل الوراثية في الفقه الإسلامي ، وفي الفصل الثاني حکم تعديل العوامل الوراثية في الفقه الإسلامي.

Abstract
Medication is one of the prescribed and legal rights that achieve an objective of the Islamic Sharia which is self- protection. With the passage of time, the field of medicine has achieved giant leaps and ushered the way for various approaches of treatment which have no longer become confined to cure existent diseases but also goes beyond the limits to the extent that it has become possible to change original genetic shape of the living organism. As a result, this medical breakthrough has caused great controversy in the society. Accordingly, this research is keen to highlight the importance of modifying the hereditary factors through genetic treatment of the living organism. Such treatment is considered an outcome of the scientific revolution and the successively rapid technological progress. Hence, it has become due to examine this massive medical development from a legal perspective since its objectives are no longer confined to cure diseases but it also allows modifying the original shape of the living organism by intruding a new gene, replacing an existent one or eradicating it. Therefore, the research at hand aims at establishing legal and medical provisions regarding modifying the hereditary factors so as to guarantee positive benefits and to avoid any negative misuses. The research includes two chapters and a conclusion. The first chapter introduces the true meaning of modifying the hereditary factors according to the Islamic jurisprudence. The second chapter displays the provisions of modifying the hereditary factors in the Islamic jurisprudence. Finally, the conclusion sums up the findings of the research.
