أحکام الکتابة والشهادة والإملال الواردة في آية الدّين وأثرها في استقرار المجتمع وأمنه (دراسة فقهية مقاصدية)

تناولت هذه الدراسة الأحکام الفقهية الواردة في آية الدّين وذلک من خلال تتبعها واستقرائها من المصادر الشرعية المختلفة، حيث بينت الدراسة أهمية الدّين وتوثيقه وحکمة مشروعيته وأرکانه وأسباب کتابته، وأهمية الوفاء به والإشهاد عليه وإملاله، کما تناولت الدراسة الأحکام الفقهية المتعلقة بذلک وأثرها على امن واستقرار المجتمع وفق مقاصدها الشرعية.
واعتمد الباحث في دراسته على المنهجين الاستقرائي والتحليلي لبيان ذلک، وتوصلت الدراسة إلى حکم إباحة الدّين ووجوب کتابته وتوثيقه والإشهاد عليه وإملاله عند المقدرة على ذلک.
وخلصت الدراسة إلى أن الالتزام بالأحکام الشرعية المتعلقة بالدّين يؤدي إلى حفظ مقصد ضروري من مقاصد الشريعة وهو حفظ المال کما يؤدي إلى استقرار المجتمع وامنه، وبعض النتائج الأخرى.

Abstract
The study examined the importance of indebtedness، the document and the wisdom of its legitimacy، its pillars، the reasons for its writing، the importance of fulfilling it، and the certification of it and its share. Jurisprudential provisions related to this and their impact on the security and stability of society according to their legitimate purposes. In this study، the researcher relied on the inductive and analytical methods to explain this، and the study reached the rule of permitting the indebtedness and the necessity of writing it، documenting it، and being committed to it. The study concluded that adherence to indebtedness rulings leads to the preservation of a necessary purpose of the purposes of the law، which is the preservation of money and leads to the stability of society and security and some other results.
