البحـث الکلامي في مؤلفــات الفقهــاء نهاية المطلب للجويني أنموذجا

ملخـــص
هذه الدراسة عُنيت ببيان وتوضيح أثر علم الکلام في علم الفقه الإسلامي؛ وذلک من خلال استعراض هذا الأثر في أهم کتب الفقه الإسلامي وموسوعاته، وهو: نهاية المطلب في دراية المذهب، لإمام الحرمين عبد الملک بن عبد الله بن يوسف الجويني الشافعي، المتوفى سنة: (478ه).
وقد تبيَّن لنا من هذه الدراسة أثر المسائل العقدية والکلامية في معالجة بعض المسائل الفقهية، وأن شخصية إمام الحرمين الکلامية کانت حاضرة في معالجة هذه المسائل.
وقد توزعت هذه المسائل العقدية والکلامية في أربعة مباحث: مسائل مقدمات علم الکلام، ومسائل الإلهيات، ومسائل التکفير، ومسائل الملل والمذاهب.
وِمن أهم نتائج هذه الدراسة:

أن علم التوحيد هو مِن أهم ما يطلب في زماننا هذا، وأن تعلم علم الکلام أصبح من فروض الکفايات.
أن مدارک الأحکام التکليفية لا تؤخذ من حيث التدقيق العقلي، بل تؤخذ مما يتناوله أفهام الناس، لا سيما ما يُبنى الأمر فيه على معنى اللفظ.

Abstract
This study aims at clarifying the impact of speech science in the field of Islamic jurisprudence by reviewing this effect in the most important books of Islamic jurisprudence and its encyclopedias. This is the end of the requirement in the knowledge of the doctrine of the Imam of the Two Holy Mosques King Abdul Malik bin Abdullah bin Yusuf Al Juwaini Al Shafi'i, 478 e).
This study shows us the impact of the doctrinal and theological issues in the treatment of some jurisprudential issues, and that the personality of the Imam of the Two Holy Mosques was present in dealing with these issues.
These doctrinal and grammatical issues were divided into four topics: the issues of the precepts of speech science, questions of theology, questions of atonement, and questions of boredom and doctrines.
The most important results of this study:
1. That the science of Tawheed is one of the most important demands in our time, and that learning the science of speech has become one of the competencies of competencies.
2 - The perception of the provisions of the mandate is not taken in terms of mental scrutiny, but taken from what is addressed by the people, especially what is built on the meaning of the word..
