العلاقة بين الرجل والمرأة الأجنبية عبر وسائل التواصل الاجتماعي "دراسة فقهية" - The Relationship Between a Man and a Non-Mahram Woman Through Social Media: “A Jurisprudential Study”

الملخـص:
تُعتبر وسائل التواصل الاجتماعي من ضروريات الحياة التي تحظى بأهمية كبيرة عند الناس، لما يترتب عليها من سرعة التواصل بينهم، والتعبير عن آرائهم، وقد استخدم بعضهم هذه الوسائل في ارتكاب ما حرم الله، فلزم من ذلك بيان رأي الشرع فيما يُرتكب لاستخدام هذه الوسائل على الوجه الصحيح.
ويهدف البحث إلى تسليط الضوء على الآثار الإيجابية لوسائل التواصل الاجتماعي وتشجيع الناس عليها، والآثار السلبية لتنبيه الناس وتحذيرهم منها وسبل مكافحتها من خلال بيان أحكامها الفقهية. واتبعت في كتابة البحث المنهج الاستقرائي الوصفي القائم على تتبع جزئيات البحث، وعرض تمهيد يتعلق بكل مسألة، أو ذكر تأصيل لها، وتحرير محل النزاع في مسائل البحث المختلف فيها، وآراء الفقهاء، وسبب الاختلاف إن وجد، وذكر أدلتهم، ومناقشتها إن وجد، وترجيح ما أراه راجحا بناء على قوة الأدلة، وما يتماشى مع العصر الذي نعيش فيه ويتوافق مع مقاصد الشريعة، وذكر التكييف الفقهي لبعض المسائل، ووضع خلاصة لكل مسألة لم يختلف أهل العلم على الحكم فيها.
وتوصل الباحث من خلال هذا البحث إلى أن وسائل التواصل الاجتماعي تستعمل في الخير وقد تستعمل في الشر، ولها آثار إيجابية وأخرى سلبية، فمن يستعملها في الخير كانت آثارها إيجابية، ومن يستعملها في الشر كانت آثارها سلبية ويعرض نفسه للعقوبة الشرعية، فيجب ضبط استعمالها وفقا لمقاصد الشريعة الإسلامية وتجنب سلبياتها.
وأوصي أولياء الأمور بفرض رقابة على أولادهم في استعمالهم لوسائل التواصل الاجتماعي وتوعيتهم بالاستخدام الصحيح لهذه الوسائل، كما أوصي جميع مؤسسات الدولة بالتصدي لظاهرة ارتكاب المعاصي عبر هذه الوسائل، ووضع الحلول المناسبة لها.
Abstract:
Social media has become an essential part of modern life, greatly valued for the speed and ease it offers in communication and self-expression. However, some have misused these platforms to engage in what is religiously prohibited, necessitating a clarification of Islamic rulings related to their proper use.
This study aims to highlight the positive aspects of social media to encourage its responsible use, while also addressing its negative aspects to warn against misuse and suggest ways to combat it through jurisprudential analysis. The research adopts an inductive descriptive methodology that traces specific issues, presents an introduction or foundational discussion for each, identifies points of scholarly disagreement, outlines juristic opinions, explores reasons for differing views when applicable, cites supporting evidence, and provides critical analysis where relevant. The study concludes with a preferred opinion based on the strength of the evidence, its relevance to contemporary reality, and alignment with the objectives of Sharia. Some issues are further addressed with appropriate jurisprudential classification, and definitive rulings are summarized where consensus exists.
The researcher concludes that social media may be used for both good and evil. When used for good, its effects are positive; when used for evil, it yields harmful consequences and may subject the user to legal accountability under Islamic law. Therefore, its usage must be governed by the objectives of Islamic law and its harms avoided.
The study recommends that parents monitor their children's use of social media and educate them on its proper use. It also calls on all state institutions to confront the phenomenon of sinful behavior through these platforms and to implement suitable solutions.
