عِلـمُ الفقـهِ المقــارنِ ودَوْرُهُ في ترسيخِ القيمِ المجتمعيةِ

إن أشرف العلوم مطلقا هو علم التوحيد؛ إذ يتصل معلومه بالرب - جل جلاله -  وشرف العلم بشرف المعلوم، ويليه في الرتبة علم الفقه في الدين وهو معرفة الأحکام الشرعية العملية وقد وسمه الفقهاء الأوائل بعلم الحلال والحرام،
 وعلم الفقه المقارن إنما هو علم الفقه وزيادة؛ من حيث عرضُ النتاج الفقهي للمجتهدين وتحقيقه وتبيين قويه من ضعيفه، وترجيح ما هو أقرب زلفي إلى دلالات النصوص ومقاصد الشريعة وغاياتها.
 وقد وقع اختياري للمشارکة ببحث – حسب تخصصي-  في هذا المؤتمر القيم بهذا الموضوع لعدة أسباب أُجمِلُها فيما يلي:

·        ضرورة تسليط الضوء على الأهمية القصوى لعلم الفقه المقارن في إصلاح المجتمعات الإسلامية بترسيخ القيم الراقية والمُثل الفاضلة، وبيان رحابة الاجتهاد الفقهي لعلماء الشريعة.
·        نفي الزيف والدَّخَلِ عن مقاصد هذا العلم الجليل وغاياته التي وضعه العلماء لأجلها؛ حتى لا يتخذه أهل الأهواء وسيلة يُتحلل بها من شرف التکاليف الشرعية، وذريعة إلى اتباع شهوات النفوس الخفية.

حداثة هذا الموضوع؛ فهو يمثل جانبا تنظيريا يصحبه تطبيق عملي في خدمة هذا العلم من جهةٍ قِيَميَّة، فلم أقف على بحث يتناول هذه الآثار الجليلة لعلم الفقه المقارن في مجال ترسيخ القيم المجتمعية.
وقد استقصيت أهم القيم المجتمعية التي يرسخها علم الفقه المقارن من خلال الخطوات العملية المتبعة في منهجه البحثي.
 
The Science of Comparative Jurisprudence and its Role in Establishing Societal Values

      The most honorable science is that of monotheism since it is closely related to the Almighty God. The honor of this science is bestowed on the learners. Then comes the science of jurisprudence since it entails knowledge of the legitimate judgments and the early jurists identified it as the science of lawful and unlawful.
Comparative jurisprudence is much more than jurisprudence since it displays the jurisprudent output of the discretionary by examining it to show the points of strengths and weaknesses, and paying tribute to the closest of them to achieve the purposes of jurisprudence.
The researcher is keen on taking part in this conference by selecting the topic of this research due to the following reasons:
There is a necessity to highlight the crucial importance of comparative jurisprudence to reform Islamic societies by establishing lofty ideals and values through the discretionary efforts of the jurists.
The need to take away falsehood and untrue ideas from the purposes of this honorable science as established by scholars so that it would not be utilized by the moody people as a means to liberate them from the restrictions of jurisprudence then they can follow their whimsical desires.
The uniqueness of this topic stems from the theoretical aspect which is followed by another practical aspect designed to serve the set of values. The research has traced the most societal values established by comparative jurisprudence through the practical steps followed in the approach of this research.
