المقاصد الشرعية لتشريع العفو عن القاتل في المجتمع الإسلامي " دراسة فقهية مقاصدية"

تتناول هذه الدراسة مقاصد الشرع الحنيف لتشريع العفو عن القاتل، وقد کان الداعي إلى اختيار الباحث لهذا الموضوع: الاعتراضات الواسعة في هذه الأيام من عدة جهات حقوقية محلية ودولية على عقوبة الإعدام، وارتباط هذه الاعتراضات في کثير من الدول بمبررات تحمل عنوان حقوق الإنسان.
وقد بيّن الباحث أنه من الخطأ بمکان أن نجعل الشريعة مدافعة عن قوانين الإعدام دون معرفة مقاصد الشريعة في إيقاع هذه العقوبة وإنزالها بمن يستحقها، وهذا الخطأ يقع به البعض عند الدفاع عن تشريع القتل قصاصاً في أحکام الشريعة، فتظهر الشريعة وکأن الإعدام مقصداً وهدفاً من مقاصدها وأهدافها، والحق أن حفظ النفوس ورعاية حق الحياة هو مقصد الشريعة الذي شرعت لأجله العقوبات الرادعة والزاجرة عن الاعتداء على هذا الحق وهدمه، ولم تأت الشريعة يوماً بحکم يقصد قتل النفوس وإزهاق الأرواح،
لذلک عقد الباحث العزم على بيان أهم الوسائل الشرعية التي يمکن من خلالها عدم إنزال عقوبة الإعدام بالمجرم القاتل دون أن يمس ذلک مقصد حفظ الحياة بضرر، ودون أن يزيل الزجر والردع في العقوبات المقررة لجريمة قتل النفس والاعتداء عليها، ومن أهم هذه المسقطات العفو.
وقد سار الباحث في بحثه هذا على المنهج الاستقرائي التحليلي والمنهج الوصفي من خلال استقراء أدلة وأقوال الفقهاء في قضية العفو باعتباره مسقطاً من مسقطات القصاص، وتحليل هذه الأدلة والأقوال، وبيان أهميتها في تحقيق مقاصد الشريعة في حفظ النفوس، وذلک ببيان مشروعية العفو، وکيفية تحقيقه لمقاصد الشريعة في حفظ النفوس على وجه لا يتناقض مع ما شُرِع من عقوبة لجريمة القتل ابتداء تتمثل في القصاص، وتتبع الشروط الشرعية المقررة عند الفقهاء، وبيان أثر هذه الشروط في تحقيق المقصد الشرعي، وبيان أثر إهدارها في هدم مقصد حفظ النفوس بشکل عام.
The Legitimate Purposes of Issuing a Pardon for the Murderer in the Islamic Society “A Purposeful Jurisprudent Study”

Abstract
This research demonstrates the legitimate purposes of the true religion to issue a pardon for the murderer. These days, the growing objections of various local and international organizations to the capital punishment compelled the researcher to carry out this study. Those objections are closely related in many countries to the calls of human rights. 
The researcher has noted that it is erroneous to allow jurisprudence to defend the laws of execution without understanding its purposes to effect this punishment on those who deserve it. Such mistake tempts some people when they try to defend retaliation in the provisions of Islamic law so that jurisprudence appears as if intended to effect capital punishment on purpose but in fact it is the right to secure people’s lives that receives the greatest interest in our jurisprudence. For the sake of such right, the act of capital punishment has been issued and to deter others from aggression and violation of others rights. The Islamic jurisprudence has never issued any sanction to kill selves or lose lives.
Accordingly, the researcher is determined to seek the legitimate means by which capital punishment could be ceased to save the life of the criminal/ murderer away from affecting the basic purpose of securing lives or removing the identified sanctions to deter killing the selves or aggression. One of those means is the pardon. The researcher has followed the analytical inductive approach and the descriptive approach through inducing the statements and clues of the jurists concerning the issue of pardon which causes retaliation to be ceased. Then the researcher analyzes those clues and statements to show their importance in achieving the purposes of jurisprudence to secure people’s lives in a way that does not contradict the true sanction of killing in jurisprudence. He also traces the legitimate conditions laid down by jurists to underline their crucial role and influence in case they are violated by obliterating the purpose of securing people’s lives in general.
