الأخذ بما عليه العمل وأثره في تحقيق الاستقرار المجتمعي دراسة فقهية تطبيقية

تتناول هذه الدراسة کيف کان الفقهاء يعيشون واقعهم العملي بما فيه من مشاکل ونوازل ويقدموا الحلول العملية المناسبة للواقع والمبنية على التأصيل الشرعي
وقال على رضي الله عنه: «حدثوا الناس، بما يعرفون أتحبون أن يکذب، الله ورسوله»
إنّ عملية التوظيف هذه يتمّ اقتطاعها أحياناً اقتطاعاً من داخل النسق المذهبي الآخر دون ملاحظة المناخ الذي تعيش فيه أو تنمو هذه المقولة أو تلک في إطاره، فنحن لا نريد الله وأحکامه ألعوبةً بيدنا نُنطقه بما نشاء والعياذ بالله، کما لا نريد أن نصدّر إسلاماً للبشر لا يمکن أن يتکيّف مع البشرية، ولو في أحد الأزمنة، ويحلّ مشاکلها التي يُعنى بها حقّاً، ما دمنا نعتقد بخلود هذا الدين واستمراريّته.
ويتجه البحث لدراسة معنى مصطلح الأخذ بما عليه العمل، اعتبار ما جرى عليه العمل عند الفقهاء، شروط الاعتبار بما جرى عليه العمل، الوقائع التاريخية لتطبيق الفقهاء لهذا المبدأ، الوقائع المعاصرة لتطبيق هذا المبدأ.
وقد توصل الباحث إلى نتائج منها أنه يشترط لاعتبار العمل شروط، منها أن يکون عمل المسلمين، وأن يکون صادرا عن الفقهاء الربانيين والعلماء المخلصين، وألا يکون العمل مخالفا للنصوص الصحيحة الصريحة، وألا يکون هذا العمل مخالفا للإجماع، وأن يجد هذا القول قبولا لدى الفقهاء ويجد رواجا للعمل به ، فإن أنکره الفقهاء فلا عبرة به .
ومنها أن ما جرى عليه العمل يدخل فيه : المسائل الاجتهادية التي هي من اختصاص ولي الأمر ، المسائل الاجتهادية التي تتعلق بالعامة ، ويتأثر بها النظام العام ، والمسائل الاجتهادية في العبادات ، المسائل التي جرى عليها العمل في أبواب الحج ، واستقرت في أذهان العامة ، وفي المعاملات کاختيار حرمة التسوق الشبکي ، وحرمة تدوال البتکوين ، وفي المسائل الاجتهادية التي أخذ القانون بأحد الآراء فيها ، النوازل  : کوضع ضوابط معينة للتبرع بالأعضاء ، وحکم الحقن المجهري لتحديد نوع الجنين .
 
Considering Reality and its influence on Achieving Societal Stability:
A Practical Jurisprudent Study

Abstract
This research glimpses how the jurists lived their real and practical lives with their hazards and issues. This enabled the jurists to introduce practical solutions that are suitable to their real world and based upon legal referential.
Ali (May Allah Bliss him) said “talk to people about what they know, do you to lie about Allah and the messenger”. The process of employment is sometimes taken from the context of the other school of thought regardless of the atmosphere in which we live or that statement grows within. Intentionally, we do not want Almighty Allah and His prescribed judgments forbid to be a malleable game to be utilized whimsically. We also want to introduce a kind of Islam suitable to all mankind of all times. That kind would solve all related problems as long we believe in its immortality and continuity.
Next, the research examines the concept of considering reality, what the jurists had at hand in their times, conditions of accepting what was at hand, the historical events that compelled jurists to apply that concept and the modern circumstance of application.
The researcher has underlined some results. First, there are some conditions to consider reality such as the peculiarity of Muslims, and the originators should be sincere and honest whether scholars or jurists. That reality does not have to be in any controversy with the true texts or in contrast with the consensus. It should be widely accepted by the jurists so that it becomes largely practical because if the jurists denied it, it would have no value.
Second, considering reality includes discretionary issues which are confined to the ruler and the discretionary issues of the public which affect the public discipline. The discretionary issues of worship, those of pilgrimage and had their influence upon the minds of the public and in transactions such as the illegality of online shopping and exchanging bitcoins. Some of the discretionary issues have been considered by law. Establishing a certain criteria to volunteering human origins, microinjection so as to specify the gender of the baby are examples of the hazards.
