الجوانب الخلقية في فقه المعاملات المالية

تتناول هذه الدراسة الجانب الأخلاقي في المعاملات ، فالمعاملات في الإسلام تحکمها قواعد ثابتة وقيم أخلاقية ينبغي التحلي بها، وهذه القواعد والقيم مستمدة من کتاب الله تعالى، ومن سنة نبيه - صلى الله عليه وسلم - ومن سير الصحابة والسلف في تعاملاتهم، منها العدل، والإحسان ، والصدق،  والأمانة،  والنصيحة، والتراحم،  والاخلاص في العمل، ونبذ الکذب ، والغش ، والخداع، والسرقة، والسطو علي المال العام، وتحريم أکل أموال الناس بالباطل بالربا، والرشوة .
  فنظام المعاملات في الفقه الإسلامي له فلسفته الخاصة إذ يخلق بين المسلمين جوًا من الحب والتعاون والإيثار، فعبارة (الدين المعاملة) صحيحة المعنى يدل على صدقها وصحتها الأدلة الکثيرة، فإن حسن تعامل التجار المسلمين قديماً کان سبباً في دخول ملايين الناس في الإسلام. وآمل أن يتحلى تجارنا بهذه المعاني الطيبة وأن يعيدوا سيرة التجار المسلمين السابقين الذين کانوا هداة مهتدين.
ويتجه البحث لدراسة فضل الکسب والحث عليه، وآداب المعاملة من النية الصالحة، والصدق، والوفاء بالعهد، وحسن الخلق إلى غير ذلک من الآداب، کما تناول البحث التفقه في علم صحيح البيع والشراء، والعدل واجتناب الظلم في المعاملات، والإحسان في المعاملات.     
وقد توصَّلت الدِّراسةُ إلى جملةٍ من النتائجِ، منها: أن الجانب الأخلاقي في المعاملات يفضي عليها ثوبًا من الجمال، والروعة، وحسن التعامل، والصدق والمسامحة ، وأنَّ الإحاطة بالأحکام الفقهية في المعاملات يجعل التعامل بين الطرفين فيه سهولة ويسر وتجنب للمحرمات. 
The Ethical Aspects of the Jurisprudence of Transactions

Abstract
This research tackles the ethical aspect of transactions. In Islam, transactions subject to fixed rules and ethical values. These rules and values are derived from the Holy Quran, the Sunnah of Prophet Muhammad (Peace be upon Him), the biographies of His companions and their transactions. Some of those values are justice, charity, truthfulness, honesty, advice, compassion, sincerity, giving up falsehood, cheating, deception, theft, burglarizing public funds and outlawing taking people’s money by means of usury or falsehood as well as bribery.
The system of transactions in Islamic jurisprudence has its special philosophy which creates a lovely atmosphere of cooperation and altruism in between Muslims. The meaning implied by the statement (religion is treatment) is true in various ways. For example, the good treatment of the Muslim traders in the past has influenced millions of people to convert to Islam and I hope that our modern traders would be characterized by such good traits to copy their ancestors who guided people along the right path.
The research is dedicated to study the virtues of profits and the ethics of treatment, truthfulness, loyalty, and good intention. It has also dealt with the true discipline of selling and buying, justice and giving up oppression during transactions as well as benevolence.
The research has found out some results such as the ethical aspect of transactions makes it more attractive, wonderful, truthful and tolerant. Being knowledgeable of the jurisprudent judgments of transactions makes deals in between the two parties easier and more tacit, yet the taboos are avoided.
