الحفاظ على مقاصد الشريعة وأثره في ترسيخ القيم المجتمعية

هذا بحث بعنوان: «الحفاظ على مقاصد الشريعة ودوره في ترسيخ القيم المجتمعية» تکلمت فيه عن مقاصد الخلق، وهي: العبادة، والعمران، والتزکية، وعن مقاصد الشرع، وهي تنقسم إلى أقسام عديدة، باعتبارات وحيثيات مختلفة، وتکلمت عن کيفية الحفاظ على مقاصد الشريعة، وبينت العلاقة بين المقاصد والقيم المجتمعية، وتوصلت إلى أن هناک تلازم بين المقاصد والقيم المجتمعية؛ فما من حکم شرعي إلا وفيه قيمة مجتمعية.
لأن الله ـ سبحانه وتعالى ـ ما شرع حکمًا لعباده إلا لمصلحة، هذه المصلحة إما جلب نفع لهم، وإما دفع ضرر عنهم، هذه المصلحة هي المقصد من التشريع والباعث عليه، وفيه قيمة خلقية أو اجتماعية، فالأحکام الشرعية ما هي إلا قيم سامية، فکل حکم شرعي لا يخلو إما أن يکون أمرًا بفعل يحقق قيمة اجتماعية، أو نهيًا عن فعل يتنافى مع تلک القيمة.
فالمقاصد الشرعية أوعية للقيم المجتمعية، وإذا تحققت المقاصد وحوفظ عليها تحققت القيم، وإذا اختلت المقاصد ولم يُحَافَظ عليها اختلت القيم.
ثم تکلمت عن أهم القيم المجتمعية:
ـ قيمة الأمن، فهو من أهم مقومات الحياة، وبه يتحقق صلاح الدنيا وعمارة الأرض.
ـ قيمة التعايش، فبها يتحقق الاستقرار والارتياح.
ـ قيمة التنمية، فهي ليست بعيدة عن مراد الشرع، وإنما تُعدّ من أعظم مقاصده.
ـ قيمة العدل، فهو أساس العمران.

The Impact of Preserving the Purposes of Sharia on Establishing Social Values

Abstract
This is research paper tackles the purposes of creations, which are worship, construction of life on the earth, and self-purification. It also discusses the purposes of Sharia, which are divided into several subcategories depending on different considerations and various conditions. The study explains how to preserve the purposes of Sharia, and it examines the relationship between such purposes and the social values, concluding that it is one of their concomitances since no legal ruling is void from a social value.
Allah the Almighty has not decreed a law for His servants to abide by except for some benefit which is either bringing on goodness or repelling harm away. Such a benefit is the purpose of legislation and the motive behind it, so it always contains a social value. The Islamic laws are never short of noble values. Every Islamic law either dictates a deed that realizes a social value, or deters from a deed that goes against a social value.
The purposes of Sharia are the vessels for social values. If they are realized and preserved, so are the values. If they are compromised or unheeded, the social values consequently crumble.
The paper handles the following major social values:
- The value of security is the most important element of life, which brings about prosperity and welfare.
- The value of coexistence is the means to achieving stability and comfort.
- The value of development which is one of the greatest objectives of Sharia.
- The value of justice is the basis of constructing life on the earth.
