حقــوق الجـار في التعمـير والطـريق دراســـة حديثيـة فقهيــة

من الأحکام التي جاءت في نصوص الکتاب والسنة ما يتعلق بحقوق الجار عامة ، وفي البناء والطريق خاصة ، وذلک لأهميتها ، وحاجة الناس لمعرفتها ، بسبب حضورها في حياتهم اليومية ، لذا عقت هذه الدراسة التي تقوم على مبحثين وخاتمة ، تناولت فيها ما يتعلق بحقوق الجار في التعمير ، حيث تم التعريف بالجار ، وفضل الإحسان إليه  ، وبيان رفع الضرر اللاحق به عند البناء ، ومعرفة ضمان الضرر اللاحق به ، کما تم تناول حقوق الجدار المشترک بين الجار وجاره من معرفة حکم الانتفاع بالجدار ، وبيان بعض الأحکام المتعلقة بعمارة الجدار المشترک
بينهما، وما يترتب على التلف بسقوطه.
کما تناول البحث حق الطريق فيما بين الجيران، ومعرفة حقوق الطريق المجملة، وضمان ما وقع فيه من ضرر بسبب التعدي في استخدامه، وبيان الأحکام المتعلقة بالطريق عندما يقع تنازع فيه بين الجيران.

THE NEIGHBOUR’S RIGHT TO BUILD A HOUSE, AND TO USE THE ROAD

Abstract
Some of the rules mentioned in the Qur᾿ān and the Prophet’s tradition are concerned with the rights of neighbour in general, and his right to build a house and use the road in particular. People need to know these rights because of their importance for their daily life. Therefore, I have conducted the research that contains two sections and a conclusion. The study tackles all that is related to the neighbour’s right to build a house: a definition of neighbour, the virtue of treating him well, explaining how to make up for any harm that affects him at the time of building, how to guarantee compensation for such harm. The study also deals with the rights concerning the wall in common between two neighbours: how to make use of it, how to construct it, and what happens if damage occurs because of its fall. In addition, the study deals with the rights concerning the road between the neighbours: the rights concerning the road in general, compensating for any harm that may happen because of misusing the road, and explanation of the rules concerning any disputes among the neighbours about the road.
