الملخـــــص:
يعتبر دفع التعارض الظاهر بين الأدلة من المباحث المهمة في علم أصول الفقه؛ لأن به يثبت كون أدلة الشرع متكاملة متعاضدة، لا اختلاف بينها -في الواقع- ولا تضاد؛ ولتلك الأهمية البالغة كان القيام بدفع التعارض مهمة مسندة إلى العلماء الراسخين دون غيرهم، ويعد الجمع أول طريق يسلكه المجتهد لدفع التعارض الظاهر بين الأدلة الشرعية؛ إذ العمل بكل منها من وجه أولى من العمل بواحد فقط وترك العمل بالآخر، وقد خصص هذا البحث لتناول موضوع في غاية الدقة؛ أولا وهو [الجمع باختلاف المحل أو الحال أوبهما معًا] كمسلكين مهمين لدفع التعارض الظاهر بين الأدلة، وقد سار البحث على كل من: المنهج الاستقرائي، والتحليلي، والنقدي، وكانت أهم نتائجه: بيان ماهية كل من الجمع باختلاف المحل والجمع باختلاف الحال، مع إبراز الفروق بينهما، وكذا تنزيلهما على بعض الأدلة الشرعية لإزالة التعارض الظاهر بينها، وليس هذا بالأمر اليسير، لأنه يحتاج إلى دقة نظر وحسن تأمل؛ لاستنباط وجه الاختلاف بين الأدلة في المورد الذي يتنزل عليه الحكم، أو في أحد متعلقاته، وكلما كان ذلك أبعد عن التكلف كان أقوى حجة وأظهر بيانًا، وأكثر قدرة على رفع الإشكال وإزالته.

Abstract
Disambiguating the apparent conflicting evidence is one of the important investigations of the science of jurisprudence principles as this proves the fact that the clues of Sharia are complementary and mutually supportive. As a matter of fact, those clues are in no controversy or opposition. For this great importance, the task of disambiguating the conflict is assigned to the well-established scholars and not to anyone else. Consensus of scholars constitutes the introductory path followed by hard workers to disambiguate the apparent conflict between legitimate clues since working on all of them together is more important than working on them individually. Accordingly, this research is designed to discuss a very sensitive topic which is combining apparently conflicting clues considering variations of locales, contexts or both together as two important approaches to disambiguate the apparent conflict between legitimate clues. The research applies the inductive, analytical and critical approaches along its course. By the end of the research, the researcher has referred to the important findings. For example, the research manages to display the essence of combining apparently conflicting clues considering variations of locales and contexts showing the differences between them. It also manages to relate them to some legitimate clues to disambiguate the apparent conflict between them and this is not a simple matter as it requires precision and good contemplation to specify the differences between the clues within the source of provision or in its peripherals. The more the research carries out such process away from artificiality, the more it becomes clear, persuasive, capable of disambiguating the conflict and removing it.
