أحکام الهندسة الإنسانية دراسة فقهية مقارنة

تهدف هذه الدراسة إلى تناول حدث علمي بارز في مجال التقنية الطبية الحديثة، وهو ما يتعلق بالهندسة الإنسانية سواء تدخل علاجي أو تحسيني، وللهندسة الوراثية اليوم التي هي أحد استخدامات الهندسة الإنسانية دور مهم في تشخيص الأمراض الوراثية والکشف عنها للوقاية منها وعلاجها، بالإضافة إلى إحداث أساليب جديدة في العلاج وتطويرها، ويعقد على العلاج الجيني الآمال بعد الله في الشفاء من الأمراض الوراثية.
 و قد اجتهدت في بيان غرض وحکم کل نوع من هذه الإجراءات الطبية، وقد خلص البحث إلى أن البحث والاکتشاف لحقيقة الهندسة الإنسانية مرغب فيه شرعًا، وأنه يحرم العبث في مکونات الکائن البشري أو أن يکون حقلًا للتجارب، وخلصت الدراسة إلى أن التدخل الجيني إنما يجوز في الخلايا الجسدية إذا رجي نفعه بضوابط ومراقبة طبية دقيقة، أما التدخل الجيني في الخلايا التناسلية فلا يجوز؛ ولذا فقد أوصت الدراسةُ بوجوب منع مزاولة التدخل الجيني في الخلايا التناسلية لمن تسول له نفسه هذا الأمر؛ لما له من آثارٍ مدمرة على حياة الإنسان نفسه، وللأجيال القادمة من بعده، ونظرًا لهذه الأهمية البالغة لهذا الموضوع جاء هذا البحث(أحکام التدخل في الهندسة الإنسانية_ دراسة فقهة مقارنة) لتوضيح مسائله، وکشف غوامضه، وبيان أحکامه؛ ليکون الناس على بصيرة في شتى ميادين الحياة.

The Rulings of Human Engineering: a Comparative Jurist Study

Abstract
 
            This study aims to discuss a scientific breakthrough in the field of modern medical technology, namely, human engineering whether for treatment or improvement purposes. Nowadays, genetic engineering, which is one of the applications of human engineering, plays a significant role in diagnosing and discovering genetic diseases in order to treat and prevent them. In addition, it has brought about and developed new treatment techniques. With the will of God, genetic engineering is the future hope for the treatment of genetic diseases.
 
            I have attempted to elucidate the objective and ruling of each of those medical procedures. The study states that exploring and discovering the truth of human engineering is preferable in the Islamic sharia. However, it is prohibited to mess with the parts of a human being, or to turn them into fields of experimentation. The study concludes that genetic interference is only permissible with bodily cells. when it’s deemed beneficial, given that it executed within safe limits, and under strict medical monitoring. Genetic interference with genital cells is not at all permissible. Hence, the study recommends the absolute necessity of preventing the practice of genetic interference with genital cells due to its destructive impacts on the lives of the persons undergoing it as well as their following generations. Given the utmost significance of the topic, the present study takes steps forwards to illustrate its issues, unravel its mysteries, and state its laws so that people would be enlightened in the various walks of life.
