أثر الخلاف في وجه الدلالة في الفروع الفقهية دراسة أصولية تطبيقية

هذا البحث يلمح الماحة سريعة، ويشير إشارة خاطفة، إلى سبب من أسباب اختلاف العلماء في استنباط الأحکام الشرعية للفروع الفقهية من النصوص الشرعية، فهو جمع بين الفقه وأصوله، حيث تکلم عن معنى وجه الدلالة لغة واصطلاحاً، ثم بين أثر الاختلاف فيه على أحکام الفروع الفقهية، التي تعتبر نتيجة لذلک الفهم للنصوص، وقد قسمه الباحث إلى مقدمة ومبحثين وخاتمة.
ففي المقدمة ذکر الباحث مدخلاً مهماً، فيه تعريف بموضوع البحث، والدراسات السابقة، وأهمية الموضوع، وأسباب اختياره، وأنه مهم وجدير بالبحث، التأصيل، ولا سيما في عصرنا الحاضر، حيث کثر فيه من يشککون فب صلاحية الشريعة الإسلامية للقاء والخلود، ويتهمونها بالتناقض وعدم الاتساق.
وفي المبحث الأول ذکر المراد بوجه الدلالة وطرق العلماء في بيانه، ثم تکلم عن الخلاف وآدابه وأثره على الفروع الفقهية.
وفي المبحث الثاني ذکر فيه نماذج أصولية للخلاف في وجه الدلالة، وأثاره في الفروع الفقهية، سواءً أکان بسبب اللغة أو العموم والخصوص، أو الإطلاق   والتقييد، أو التعارض والترجيح، أو الاستثناء، ثم أتبع ذلک بخاتمه ذکر أهم النتائج التي توصل إليها.

The Impact of Disagreement on the Point of Evidence in the Branches of Jurisprudence: A Fundamental Applied Study

Abstract
This paper swiftly touches upon one of the reasons for scholars’ differences in deducing rulings of Sharia from the legal texts of fiqh (jurisprudence) branches. It combines jurisprudence and its principles by first unfolding the lexical and contextual meanings of the point of evidence, then exploring the impact of disagreement on the rulings of the branches of fiqh, resulting from the understanding of legal texts. The study comprises an introduction, two sections, and a conclusion.
In the introduction, the researcher starts out with an introduction presenting the study's topic, the previous studies, the significance of the topic, the reasons for choosing it, being worthy of studying, It also notes the significance of the study, particularly at the present time where many researchers raise doubts regarding the validity of the Islamic Sharia and accuse it of inconsistency and contradiction.
Section one elaborates on the meaning of 'point of evidence' and the scholars’ approaches to explain it. Then, it mentions the etiquettes of disagreement and its impact on the branches of fiqh. The second section presents fundamental examples of disagreement about 'point of evidence' and its impact, either due to language, the general and the specific, the restricted and the absolute, contradiction and preference, or exception. A conclusion follows to summarize the major findings of the study.
