قواعد المصلحة وتعلقها بنوازل فقه الأقليات الإسلامية

تناولت في هذا البحث قواعد المصلحة وتعلقها بنوازل فقه الأقليات المسلمة، هادفاً من ذلک إلى بيان براعة علم الأصول، ومقدرته على مسايرة مستجدات الأمة ونوازلها في کافة العصور، وبخاصة فيما يتعلق بالتأصيل لنوازل فقه الأقليات المسلمة موضوع الدراسة؛ بغية المساهمة في معالجة الکثير من النوازل التي ألمَّت بالأقليات المسلمة ولها تعلق بقواعد المصلحة، فإن معرفة القواعد وضبط المفاهيم وإدراک کيفية ابتناء الأحکام لتکون موافقة وملائمة لمقاصد الشريعة أمر من الأهمية بمکان.
وقد انتظم البحث في مقدمة شملت أهمية الموضوع، وأسباب اختياره، وأهدافه، ومشکلته، ومنهجه، ودراساته السابقة، وتمهيد: تطرقت فيه للتعريف بمصطلحات الدراسة، ومبحثين، تناول المبحث الأول: القواعد المتعلقة بالمصلحة وانتظم تعدادها في ست قواعد ارتبطت في مجموعها برفع الحرج ودفع المشقة، وکان المبحث الثاني عن ضوابط استعمال قواعد المصلحة في نوازل فقه الأقليات الإسلامية وکيفية ابتناء أحکام نوازل الأقليات عليها، ليشمل الحديث عن ضوابط وموانع استعمال قواعد المصلحة في نوازل فقه الأقليات المسلمة، وکيفية ابتناء أحکام نوازل فقه الأقليات الإسلامية على قواعد المصلحة، وحاجة الفقيه والمفتي إلى معرفة، ثم کانت  الخاتمة والتي ضمت نتائج البحث وتوصياته المقترحة.

The Principles of Public Interests and its Relevance to Issues on Disaster-Related Jurisprudence for Muslim Minorities

Abstract
This paper tackles the principle of public interests and its relevance to the issues of the jurisprudence related to Muslim minorities. The objective is to elucidate the ingenuity of the science of the Principles of Jurisprudence, and its ability to cope with the newly emerging issues related to the Muslim Nation, especially with regard to establishing rulings for the contemporary issues of the Muslim minorities presented in the present study. It aims to deal with many of the emerging issues that arise with the Muslim minorities, which are related to the principle of public interests. It is of great importance to realize the principle, understand the related concepts, and grasp the underlying fabric of issuing rulings in accordance with the objectives of Sharia (the Islamic laws). The conclusion presents the research findings and the suggested recommendations.
