تأثر الفتوى بالعرف (الأسباب والضوابط) دراسة تأصيلية تطبيقية

تأتي أهمية هذا البحث بکونه يکشفُ ما تمتاز به الشريعة الإسلامية من خصائصٍ تتجلى في ثبات أحکامها، مع مرونتها وصلاحها لکل زمانٍ ومکان، کما أنه يُعد من الموضوعات المتفق عليها بين المذاهب الفقهية الأربعة، کما أنه من خلال تحريره يُسهم في تقديمِ الحلول للمشکلاتِ التي تواجه المشتغلين بالفتوى.
ويهدف البحث لتحرير أسباب تأثر الفتوى بالعرفِ، وتحديدُ ضوابط ذلک التأثر التي تمنعُ من الإفراط أو التفريط في هذا المجال، سواءٌ تعلقت بالمفتي أو غيره.
وبين البحث أن أسباب تأثر الفتوى بالعرف هي:
1-تغير الزمان، والمقصود به تغير عادات الناس في زمان ما عن عادات الناس في زمان آخر، أو في الزمن الأول وتغير الزمان شامل لفساد الزمان، أو صلاحه.
2- تغير المکان، والمراد به المکان الذي انتشر فيه العرف السابق، ثم تغير العرف في المکان الجديد، فلکل مکان عرفه، في التعامل.
3-تغير الأحوال، والمرادُ تغير ظروف وأحوالِ الناس.
وأما الضوابط فنوعان: ضوابطُ عامة، وتشمل: عدم ُمخالفة النص الشرعي الصريح، وأن يکون العرف منتشراً وغالباً، وأن يکون التغير ثابتاً وواضحاً، وأن يکون التغييرُ موافقاً لمقاصد الشريعة.
وضوابط خاصة، وتشمل: الضوابط الخاصة بالمفتي، والضوابط الخاصة بالحکم، والضوابط الخاصة بأحوال الحکم.
وقد أبرز البحث أن تغير الأحکام الاجتهادية أحد خصائص الفتوى التي تدل على عظمة هذا الدين، وصلاحه لکل زمان ومکان.                  وبالله التوفيق.

HOW TRADITION AFFECTS FATWA, REASONS AND RULES: AN ADAPTIVE APPLIED STUDY

Abstract
The significance of this research paper consists in pointing out the characteristics that distinguish the Islamic Law such as the stability of its rules and their flexibility which makes them fit for all times and places. This is agreed on by the four schools of jurisprudence. The research topic contributes to finding solutions to the problems that face those who issue fatwas. This research aims to study the reasons that make fatwa affected by tradition, and to determine the rules that control that effect. These rules can prevent the people in charge of fatwas as well as others from exceeding the proper limits of fatwa or falling short of them. According to this study, the reasons for the effect of tradition on fatwa are:

Changing time: This means that the habits of people at one time change from their habits at another time.
 Changing place: This refers to the place where the previous tradition was prevalent, and then the tradition changes in the new place.
Changing circumstances: This refers to people’s circumstances.

The rules are of two types: General rules that include not contradicting any explicit religious text, spread of tradition and its superiority, permanence and clarity of the change, and suitability of the change for the objectives of Islamic law. As for the specific rules, they include rules concerning the scholar who issues the fatwa, rules concerning the decision, and rules concerning the circumstances of the decision.
