دلالـة الخـاص عنـد الحنفيـة دراسة فقهية تطبيقية

ملخص البحث
هذا البحث في دلالة الخاص وحکمه عند الحنفية، وما يترتب عليه من أحکام، والخاص عند الحنفية: هو اللفظ الموضوع لمعنى واحد معلوم، کلفظ السجود فإنه موضوع لمعنىً واحد معلوم، وهو وضع الجبهة على الأرض. وحکم الخاص عند الحنفية: دلالته على معناه قطعًا، فلا يراد به معنىً آخر غير المعنى الموضوع له في اللغة، کما أن الخاص بيِّنٌ بنفسه لا يحتاج إلى بيان وتوضيح، ولا يزاد عليه بخبر الواحد؛ لأن الزيادة عند الحنفية نسخ، ونسخ القطعي بالظني لا يجوز. أما غير الحنفية من جمهور الفقهاء، فقد ذهبوا إلى أن الخاص قطعي الدلالة على معناه، لکنه يحتمل البيان والزيادة عليه بخبر الواحد، والزيادة ليست نسخًا عندهم، بل تزيد حکمًا آخر.
وقد تناول البحث بعض المسائل الفقهية التطبيقية من أبواب الفقه المختلفة على مفهوم دلالة الخاص عند الحنفية، ويهدف البحث إلى إبراز دلالة الخاص وحکمه عند الحنفية، وبيان دقة منهج الحنفية في استنباط الأحکام من أدلتها، وإنزال کل دليل على درجته من خلال دراسة بعض المسائل الفقهية، وقد اعتمد الباحث على المنهج الوصفي التحليلي، الذي يقوم على توصيف الأقوال وتحليلها ومناقشتها ورد الاعتراضات الواردة عليها والترجيح بينها، ومن أهم نتائج البحث أن  الخاص بيِّنٌ بنفسه، لا يحتاج إلى بيان ولا يقبل الزيادة، وأن الطمأنينة في الرکوع والسجود واجبة عند الحنفية، وليست فرضًا کما قال غيرهم، والطهارة في الطواف واجبة عند الحنفية، وليست فرضًا کما قال غيرهم.،  وعدة المرأة التي تحيض: ثلاث حيضات عند الحنفية، وحد الزاني البکر عند الحنفية هو الجلد فقط، ولا يجب عليه النفي خارج البلد.
The Significance of Specificity for Hanafism
An applied Jurisprudential Study

Abstract
        This research highlights the significance of specificity for Hanafism as well as its provision and the resultant rulings. Specificity for Hanafism signifies the specific meaning of a certain word such as the word prostration which signifies a well- known meaning of putting the forehead on the ground. The provision of specificity for Hanafism absolutely signifies its true meaning. It can hardly signify any meaning in the language rather than the specified one. In addition, specificity is clearly manifested in a sense that it is no need of explanation or interpretation. There is no need for a single addition as additions for Hanafism simply means copying and copying the absolute by means of the hypothetical is inadmissible. As for the non- Hanafi jurists believed that specificity absolutely signifies its meaning, but it is likely to have more explanation and a single addition which does not signify copying. It adds another provision. Accordingly, the research handles some applied jurisprudential issues selected from various chapters of jurisprudence that study the concept of specificity for Hanafism. The research aims at clarifying the significance of specificity and its provision for Hanafism showing the exact approach of Hanafism throughout deducting the provisions by means of their evidence ranking every single evidence through studying some jurisprudential issues. The research follows the analytical descriptive approach which relies on describing, analyzing and discussing the statements as well as refuting the objections raised against them and selecting the most preponderant ones. One of the most outstanding findings of this research is that specificity is itself apparent and it is in no need of explanation or addition. Moreover, tranquility in kneeling and prostration is due for Hanafism. It is not an obligation as others believe. Purity during circulating Al- Ka'ba is also due for Hanafism, not an obligation. The waiting period of the woman who menstruates is three periods for Hanafism. The penalty of a fresh adulterer for Hanafism is only lashing and banishment is not due.
