مقاصد السنة النبوية في التشريع تحريـم نکاح المرأة على عمتها أو خالتها أنموذجــــاً

الملخــــص :
هذا البحث يهدف إلي إبراز أهمية علم المقاصد في الشريعة الإسلامية ، حيث الحاجة إلي إظهاره ضرورة، لاسيما في هذا العصر ، وقد تناول هذا البحث تعريف وأهمية هذا العلم والمقومات التي يحتاج إليها من يتصدي لبيان مقاصد السنة في الإسلام ، والعلاقة بين مقاصد القرآن ومقاصد السنة ، ثم انتقل البحث لبيان مقاصد السنة في تحريم الجمع بين المرأة وعمتها وبينها وبين خالتها بين الاستقلال بالتشريع وتخصيص الحکم العام، واعتمد البحث علي المنهج الاستقرائي التحليلي في جمع ودراسة الروايات المرفوعة والموقوفة الواردة في دواوين السنة المطهرة ،وتحرير قول أهل العلم أنه لم يصح في ذلک سوي حديث أبي هريرة ـ ¢ ـ ، وبيان آراء العلماء في هذه المسألة ، وذکر أوجه بيان السنة للقرآن في تحريم نکاح المرأة علي عمتها وخالتها ، وانتهاء بحصر مقاصد السنة من هذا النهي ، وأهم نتائج هذا البحث إثبات استقلال السنة بتشريع الأحکام ومنها تحريم نکاح المرأة علي عمتها أو خالتها، وأن الأحاديث الواردة في ذلک بلغت حدَّ الشهرة، وانعقد الإجماع بعدم جواز الجمع بين المرأة وعمتها أو خالتها ولا ينکر ذلک إلا مکابر أو معاند .

Abstract
 
    This research handles the importance of the objectives of Islamic Sharia where there is a need to display it especially in this age. Next, the research defines the objectives, the importance of this science and the basic elements needed for those who are keen on clarifying the main objectives of Sharia and the prophetic Sunnah. After that the research tackles the issue of preventing a woman from marrying her aunt's husband in between the independence of legislation and specifying the general rule. The research follows the inductive- analytical approach throughout the collection and study of the attributed or private transmission inherited in the registers of the purified Sunnah. The research also examines the statements of the scholars especially the only authentic one concerning the Hadith of Abu Hurairah - may Allah be pleased with him – as well as the scholars’ views regarding this issue. In addition, the research states the aspects of the Sunnah which clarify the Holy Qur’an regarding the prohibition of a woman’s marriage to her aunt's husband. The research concludes with counting the objectives of Sunnah beyond this prohibition. The most outstanding findings of this research have proved the independence of Sunnah concerning the legislative provisions. One of those provisions is that of preventing a woman from marrying her aunt's husband. Moreover, there are plenty of well- known Hadiths related to this issue and the consensus agrees that it is prohibited for a woman to marry her aunt's husband and the one who refuses this provision is either an arrogant or stubborn.
