الملخــــص
يهدف هذا البحث لبيان ماهية مفهوم المخالفة، وقد انتظم في مقدمة وفصلين وخاتمة، تناول الفصل الأول التنظير والتأصيل لمفهوم المخالفة، وحجيته وأقسامه، بينما تناول الفصل الثاني حالات إلغاء مفهوم المخالفة، وقد تضمن ذکر سبع عشرة حالة لحالات إلغاء مفهوم المخالفة مع التمثيل لکل حالة، وإن کانت هذه الحالات ليست کلها مسلمة عند الجميع، ثم تناول البحث في جانبه التطبيقي صورا عملية لحالات إلغاء مفهوم المخالفة من کتاب أضواء البيان لمحمد الأمين الشنقيطي.
والمنهج المتبع،المنهج الاستقرائي الاستنباطي، وذلک من خلال تتبع الدراسات التطبيقية لحالات إلغاء مفهوم المخالفة بمختلف مراحلها الزمنية، والوقوف على طرق العلماء ومناهجهم في ذلک.
ومن النتائج التي توصلت إليها في هذا البحث: اختلاف تقسيمات الأصوليين للدلالة، ووجود اصطلاحات مشترکة تطلق على دلالات مختلفة وفي بعض الأحيان متقابلة، واختلاف الأصوليون في حصر أنواع مفهوم المخالفة.

Abstract
         The research at hand aims at displaying the true essence of the concept of infringement. It includes an introduction, two chapters and a conclusion. The first chapter is dedicated to theorizing and originating the concept of infringement, its authority and its divisions. Whereas the second chapter discusses the cases of abolishing the concept of infringement and it includes around seventeen cases where the concept is abolished giving examples for each case. However, those cases are not taken for granted in general, the research has handled, in its practical perspective, practical forms of the cases of abolishing the concept of infringement as seen in the book of Adwaa' Al- Bayan (The Light of Truth) written by Mohammed Al- Ameen al- Shenqeety. The research applies the inductive and deductive approach through tracing the practical studies of the cases of abolishing the concept of infringement in its various temporal phases as well as highlighting the methodologies of scholars and their approaches regarding this issue. As for the findings of this research, the researcher has found out that the key reason beyond having various classifications by the fundamentalists was only for guidance. The second finding was that there are common terms used to signify various indications which are occasionally in opposition. Finally, the fundamentalists disagreed over listing the types of the concept of infringement.
