تتمحور هذه الدراسة حول تأصيل العلاقة ما بين المصلحة والنص الشرعي کونه الکلام الصادر من المشرع لبيان التشريع عند الإمامين الغزالي والطوفي، وتفسير ما جاء عندهما تفسيراً علمياً دقيقاً، مع بحث جدلية تقديم أحدهما على الآخر، من خلال التطرق إلى عرض اتجاهاتهما وأدلتهما والرد عليها ومناقشتها. وتهدف الدراسة إلى بيان مدى حقيقة تعارض المصلحة والنص وتقديم أحدهما على الآخر عند الإمامين الغزالي والطوفي، مما يُضيّق الهوة والفجوة المصطنعة بين توافق الأصلين ومدى تعارضهما. کما کشفت نتائج الدراسة على أن اختلاف منهجية الإمامين في العمل المصلحي کان بناء على اختلافهما في حقيقة المصلحة، کما أن مقولة الإمام الطوفي في تقديم المصلحة على النص تحتاج إلى المزيد من التحقيق والتمحيص والموضوعية في البحث، ومحاولة المقاربة قدر المستطاع ما بين موقف الطوفي وما بين ما قاله غيره..

Abstract
This research revolves around originating the relationship between interest and the legitimate text، as being the word of the divine legislator، to clarify the legislation of the two Imams; al- Ghazali and al- Taufi. The research is also keen to introduce scientific interpretations of the output of the two Imams with the possibility of researching the dialectics of prioritizing one of them over the other through displaying their predispositions، their evidence through discussion and direct responses. The research is also keen to investigate the truth of controversy between interest and the text as well as the possibility of prioritizing one of the two Imams; al- Ghazali or al- Taufi، over the other something that would narrow the factitious gap between the accordance of the two fundamentals and their contradiction. The findings of the research show that the difference in between the two methodologies of the two Imams regarding the beneficial work could be traced back to their difference around the truth of interest. In addition، the statement of Imam al- Taufi concerning prioritizing interest over the text needs more investigation through an objective research study as well as compromising the attitude of al- Taufi and what others have said as far as possible.
