قواعد الضرورة ودورها في معالجة الواقع الفقهي لجائحة کورونا

ملخص البحث:
تناولت في هذا البحث قواعد الضرورة ودورها في معالجة الواقع الفقهي لجائحة کورونا ، هادفا من ذلک إلى بيان براعة علم القواعد الفقهية ومقدرته على مسايرة مستجدات الأمة ونوازلها في کافة العصور، وبخاصة فيما يتعلق بالتأصيل لنوازل وباء کورونا موضوع الدراسة؛ بغية المساهمة في معالجة الکثير من النوازل التي ألمَّت بالمسلمين بسبب جائحة کورونا، مستخدماً عدة مناهج علمية توصل إلى المطلوب کان على رأسها المنهج الوصفي والاستقرائي، والمقارن، والاستنباطي. 
وقد انتظم البحث في مقدمة وثلاثة مباحث وخاتمة، وشملت المقدمة إشکالية البحث، وأهميته واهدافه وحدوده ودراساته السابقة ومنهجه العلمي، ثم هيکلته.
وتناول المبحث الأول الحديث عن قواعد الضرورة وعلاقتها بجائحة کورونا وانتظم تعدادها في أربع قواعد ارتبطت في مجموعها برفع الحرج وازالة الضرر، وفي کل قاعدة يتم التعريف بها، ثم الکشف عن علاقاتها في جانبها القاعدي التأصيلي بجائحة کورونا. وجاء المبحث الثاني والثالث في توضيح الأثر العملي لقواعد الضرورة في جائحة کورونا، وکيفية إسهام قواعد الضرورة في استنباط بعض الأحکام الشرعية لبعض المسائل الفقهية المتعلقة بجائحة کورونا، وتم الاستدلال على ذلک ببعض المسائل الفقهية التي جرى توزيعها على قواعد الضرورة التي تضمنها البحث، ثم کانت الخاتمة والتي ضمنت نتائج البحث وتوصياته المقترحة.

Abstract
The research at hand displays the rules of necessity and their role in confronting the jurisprudential reality of corona virus disease as a pandemic. The main objective of this research is to emphasize the facility of the jurisprudential rules and their ability to cope with the recent developments and mishaps of the nation in all ages with specific reference to the calamity of corona epidemic; the subject matter of this research. The research also intends to contribute to the treatment of a great deal of the misfortune that came over the Muslims in consequence of the corona pandemic. The research relies on some approaches to achieve the intended objectives. Hence, the research applies the descriptive, inductive, comparative and deductive approaches. The research includes an introduction, three chapters and a conclusion. The introduction highlights the issue of the research, its significance, its objectives and limits, the previous studies, the scientific approach applied and the framework. The first chapter deals with the rules of necessity and their intent relations with corona virus disease as a pandemic. The rules have been classified into four; all of them intend to remove the hardships and prevent damage. Each rule is defined first then her relations with corona virus disease are handled fundamentally. The second and third chapters clarify the scientific effects of the rules of necessity of corona virus disease and how these riles contributed to the induction of some legitimate provisions relevant to jurisprudential issues of corona virus disease as a pandemic. This has been proved by some jurisprudential issues as distributed over the rules of necessity included in this research. Finally, the conclusion sums up the findings of the research and the proposed recommendations.
