فهذا البحث عنوانه: " طلاق المخطئ بين الديانة والقضاء دراسة فقهية معاصرة " أردت فيه بحث هذه القضية الشائکة، والکشف عن أحکمها، واستجلاء موقف الفقهاء منهت، من حيث قبوله ديانة وقضاء أو قبوله ديانة بعيدا عن الحکم القضائي، لا سيما في العصر الحاضر الذي انتشرت فيه وسائل التواصل الحديثة، وقد کثر الحديث عن هذا النوع من الطلاق، وطُلِبت فيه الفتوى کثيرا. غير أني لم أعثر على عمل أکاديمي خصه بدراسة وافية تبين جوانبه، وتستجلي أحکامه، وتوضح صوره المتجددة، مع مدي الحاجة لتلک الدراسة في وقتنا الحاضر.

Abstract:
Praise be to Allah، Lord of all creation، peace and blessing be upon the best of all creatures; Prophet Muhammad (peace be upon him، his family and all his companions). This research، entitled "The Unintentional Divorce in between Religion and the Judiciary System، a Modern Jurisprudential Study"، examines a thorny issue، its provisions، jurists' opinions regarding the issue whether it is approved religiously and/ or judicially. The research also discusses the provision if it is approved by religion away from the judicial sentence especially in the modern age where modern social media programs have flourished. In addition، people talk a lot، these days، about such kind of divorce. People are also eager to seek advisory and legal opinions (fatwa) concerning this kind of divorce. However، the researcher has hardly found any academic work that thoroughly studied the issue in all respects، provisions or renewable and ever- changing forms. Accordingly، there is a pending need to launch various studies، at the present time، to highlight this issue.
